Privacy Policy

This Privacy Policy, any additional terms (as defined below) that may exist, and the Terms of Use available at [Please insert link] ("Terms of Use," and all of them together – the "Terms of Use"), govern the use of the ultrasound operator training system ("the Simulator") of SimHawk Ltd., company number 516283074 (hereinafter: "the Company"), the website [www.simhawk.ai] ("the Website," and together with the Simulator – "the System"), and the services ancillary to the System ("the Service"). Regarding terms that are not defined in this Privacy Policy, the definitions set forth in the Terms of Use shall apply. The purpose of this Privacy Policy is to explain the Company's practices regarding user privacy, how the Company uses the information provided to it by users or collected by it during the use of the Company's services.
This Privacy Policy is written in the masculine form for convenience only, and it applies in this manner to all users.
Any user who wishes to use the Website, the Simulator, the Service, or any part thereof ("User"), accepts the Terms of Use (including this Privacy Policy) and undertakes to act in accordance with them. If you do not agree to the Terms of Use, you must not use the System or the Service. The Company reserves the right to change any of the Terms of Use (including this Privacy Policy) from time to time. Any such change will take effect immediately. The Company recommends that users regularly check the Terms of Use.
The user has no legal obligation to provide any data or information about themselves, however, if certain data or information is not provided to us, we may not be able to allow the provision of the Service to the user.

1. Types of Information
1.1 During the use of the Service, the System, and/or parts thereof, data and information are collected about users, as detailed below. Some of the information and data identify you personally ("Personal Information"), and some do not identify you personally.
1.2 Among other things, the Company processes user information and Company data.


"User Information" - is personal information about any of the users. 
(1) Such as first name, last name, ID number, email address, phone number, information about the trainee's academic studies (such as the educational institution, year of study), the organization that referred the user, feedback about actions a trainee performs in the System during practice or exercises, bank account details, credit card details, etc.


(2) "Company Data" - consists of data related to any of the users, the use of the System, the Service, and/or parts thereof.


2. Method of Information and Data Collection.
As part of the use of the Company's Service, data on users is collected, among other things, as follows:


(1) User Information. User information is collected, among other things, as follows -
When using the Website, the Service, the System, or any part thereof, you may be required to provide the Company with personal information or other data. For example, when registering for the Service and creating a user account, you will be required to provide trainee account details or evaluator account details. In addition, you will provide us with your login details, which are hereby clarified to be confidential information of the Company.


(2) In a conversation with the Company's representatives (including call recordings), emails, and correspondence with the Company.


(3) In addition, user information may be collected by the Company from third parties, for example, to verify information you have provided or to enable the provision of the services. For example, we may be given additional details about trainees from evaluators and/or from the organization that referred the user. Similarly, details about evaluators and trainees may be given to us by institutions on behalf of which the trainees work.


(4) Automatic Documentation Mechanism - In every operation, the Company examines the user's connection details and operates algorithms to block accounts that appear to be operating outside the expected usage envelope.


2.2 Company Data.

Company data is collected, among other things, as follows -
(1)  By separating identifying data from user information.
(2) Data about exercises is collected when users perform exercises.
(3) When browsing the Website, browsing data and data received from the user's browser and/or the System they are using are collected, including the user's Internet address (IP), identifiers of the Systems the user is using (for example, UDID device identifier, computer name, model and serial number).

(4) The Company collects aggregated data, statistical data, and other data that are derived from user information, other Company data, and/or other information and data that are provided and/or collected in the Service and/or the System and/or part of them. For example, data on learning patterns and use of the Service, the System, and parts of them.


2.3 Consents.
The consents that a user gives in this Privacy Policy for the use of user information will also apply to "information" as defined in the Privacy Protection Law, 5741-1981 ("Privacy Protection Law"), as well as to other data that is not necessarily information (such as data about your private affairs and the privacy of your personal life), Company data, technical information, and aggregated statistical data, etc. This does not derogate from the Company's right to use this data, unless the use is explicitly prohibited by law. The Company's services are not directed at children under the age of 18, and we do not knowingly collect personal information from children. If a person under the age of 18 uses the Company's services, such use will be blocked and we will do our best to delete any personal information stored with us regarding them.


3. Use of Information.
The information collected is used for the Company's business activities, including the operation of the Company's website and the provision of the Company's services, and in general:
(1) To enable the use of the Service, the System, and/or any of them, services and/or products of the Company and/or third parties;
(2) To improve the user experience and enrich the content in the System and/or the Service;
(3) For various research and development purposes, including the development of new products and services;
(4) To identify the user during repeated entries to areas that require registration and to save the need to enter personal details at every entry;
(5) To enable the provision of indications and the performance of analysis about the functioning of the System against additional data;
(6) To enable personalized adaptation of the Service;
(7) To generate feedback about actions a trainee performs in the System during practice or exercises and to provide this feedback to the organization that referred the trainee and to the evaluator, in some cases. It is clarified that these organizations have different policies, documents, and practices from those of the Company regarding personal information and/or data about any of the users they referred. The Company is not responsible in connection with these policies, documents, and practices and is also not responsible for the actions and/or omissions of these organizations with the user information that will be given to them.
(8) To send information from time to time about the Company's services that the Company provides, as well as services provided by the Company's business partners. This, including by sending advertisements as defined in the Communications Law (Bezeq and Broadcasting), 5742-1982 ("Advertisement") and/or direct mail as defined in the Privacy Protection Law ("Direct Mail").
(9) For future contact with users;
(10) For the purpose of providing details about you to our business partners, if you actively and specifically agree to the provision of these details;
(11) To comply with the requirements of any law and also to assist competent authorities and any third party, when the Company believes in good faith that it has a legal or moral obligation to do so;
(12) For the purpose of creating statistical and/or aggregated information, processing it, displaying it, and/or providing it to third parties.
(13) For information security purposes, fraud prevention, and monitoring of violations of the Terms of Use.
(14) For communication with potential customers and customer service.


4. Advertising and Direct Mail.
The Company may use the information it has in order to offer users targeted advertising, products and/or services that it believes are suitable for the Company's customers, and also to personalize the Company's website and the advertisements on the Company's website according to the visiting habits and preferences of its users.


You agree that the Company will use the information collected in order to contact you and send you content, including advertisements and direct mail, whether by itself or by third parties, whether for itself or for third parties. The sending of content may be performed by any means of communication, including mail, email, phone and mobile phone, including recorded messages and SMS messages, fax, email, social networks and other means.
You are entitled, at any time, to notify of your refusal to receive advertisements, including direct mail from the Company, and to withdraw your consent by sending a removal message to the address [info@simhawk.ai] to the Company's service team. After receiving the request, the sending of content to you will be stopped, but it is possible that the information about you will continue to be stored in the Company's database subject to the provisions of any law.


5. Provision of Information to a Third Party.

The Company may transfer information (including by way of providing access) to third parties in connection with the Company's services and/or business activity, among other things


(1) For the purposes appearing in this Privacy Policy, for the realization of the purposes permitted to the Company by law, and for the realization of the Company's legitimate interests.


(2) As part of the transfer of information to external suppliers for the purpose of receiving the Company's services, such as the operation of the Company's website, the operation of the information systems, storage services, and information management systems.


(3) To the organization that referred the evaluator and/or to the trainee.
(4) When the Company has received your consent to the provision of the information, whether explicitly or implicitly;


(5) As part of a collaboration with the Company's partners as part of the Company's routine activity and/or for the purpose of providing the Company's services to the Company's customers. For example, we may transfer information to the professionals who will handle all aspects of the installation or maintenance of the System.


(6) When the third party is a parent company, subsidiary, or affiliated company of the Company.


(7) When the provision of information is required by law and/or as part of legal proceedings and/or as part of a report required to a competent authority, and also if the Company receives a court order instructing it to provide personal information and/or other information about you to any third party and also when the Company believes in good faith that it has a moral obligation to do so;


(8) In any dispute, claim, lawsuit, demand, or legal proceeding, if any, between you and the Company and/or anyone on its behalf.


6. Use of Cookies and Data Collection Technologies
The Company may use cookies ("Cookies") for the purpose of improving the browsing experience on the Company's website and for its ongoing and proper operation. Internet browsers include the option to prevent the receipt of "Cookies" and the option to delete existing "Cookies" files. It should be noted that choosing not to allow the receipt of "Cookies" or, alternatively, deleting existing "Cookies" files, may harm the user experience on the Company's website.
For the purpose of managing its business, including for the purpose mentioned above, the Company may allow third parties such as Google Analytics to also use technologies for the purpose of collecting data from the use of the Company's website such as a device identifier, IP address, and Advertising ID. The mentioned third parties are external parties as defined in the Terms of Use and the Company has no control over the practices used by those parties.


7. Information Security
The Company considers information security a topic of central importance. However, the Company does not guarantee that its services will be completely immune from unauthorized access to the information stored in them, and it will not be liable to the users for any damage, direct, indirect, or consequential, that may be caused to them as a result of the exposure, provision, or use of user information, without permission and in violation of the law, including in the event that this was caused by mistake or as a result of unauthorized access that was performed in violation of the Company's procedures.


8. Your Rights in the Information
In cases where the law allows it, a person is entitled in certain circumstances to review the information about them held in a database. A person who has reviewed the information about them and found that it is incorrect, incomplete, unclear, or out of date, is entitled to contact the owner of the database with a request to correct the information. If you wish to contact us to exercise your rights by law, you are invited to contact the contact persons.


9. Transfer of Information Outside Israel
We may transfer and/or store the information about you outside the jurisdiction of Israel. It is possible that the laws relating to privacy and information security in the jurisdiction to which the information will be transferred, may not be as comprehensive compared to the laws in force in Israel. In such a case, we will try to take steps to ensure a similar level of protection for user information. You give your consent to such a transfer and you release the Company from any malfunction related to the storage service provider such as AWS (Amazon).


11. Reservation of Rights
The Company reserves the right to make use of data, details, and/or information for which there is no legal restriction, according to this Privacy Policy and even beyond, unless it is prohibited by law, and you will not have any claim, lawsuit, or demand against the Company in this matter. The Company reserves the right to use anonymized data without any limitation.
